New European Dual-Use Regulation

On the topic of "The new EU Dual-USE Regulation in practice", my colleague Catharina Schneider and I participated in a webinar on October 21.

As administrators in export control within the logistics department at Transo-Pharm, we are aware of the importance of export control and compliance with European and national regulations. Also because of the high fines and the risk of criminal liability for violations of foreign trade law.

Dual-use goods are goods with a civilian but possibly also military purpose. These are goods with a special significance in foreign trade. Among other things this Regulation restricts the movement of these goods, establishes approval criteria and also regulates the provision of services as well as technical support services and software offerings.

The EU considers exporters, intermediaries and providers of technical assistance to be under an obligation to contribute to trade control and to identify sensitive transactions with the help of screening measures. Also, with the help of an internal program for correct behavior (ICP = "internal compliance program").

On September 09, 2021, the new Dual-Use Regulation (EU) 2021/821 came into force. Here, the requirements for economic operators are made clearer. In addition, more control and transparency between EU member states is to be created.

Transo-Pharm is very well positioned in the areas of export control and compliance screening and is always "up to date" through regular training. Various training and further education measures help to change our perspective, to critically examine our own system and to adapt it to the new circumstances. We do this in order to fulfil our aspiration of creating the best possible work conditions.
