Dual-use goods are goods with a civilian but possibly also military purpose. These are goods with a special significance in foreign trade. Among other things this Regulation restricts the movement of these goods, establishes approval criteria and also regulates the provision of services as well as technical support services and software offerings.
The EU considers exporters, intermediaries and providers of technical assistance to be under an obligation to contribute to trade control and to identify sensitive transactions with the help of screening measures. Also, with the help of an internal program for correct behavior (ICP = "internal compliance program"). On September 09, 2021, the new Dual-Use Regulation (EU) 2021/821 came into force. Here, the requirements for economic operators are made clearer. In addition, more control and transparency between EU member states is to be created.
